NEWPORT — A grand jury met at the Sullivan County Superior Court on Sept. 19 and indicted several people.
Talyen R. McGuire
Talyen R. McGuire, 29, of 249 Old Claremont Road, Claremont was indicted for bail jumping. McGuire was released on bail pending a court appearance for aggravated felonious sexual assault, an offense punishable by a maximum term of imprisonment of more than 15 years. He failed to appear in Sullivan County Superior Court on Sept. 11 for a final pretrial as required by the conditions of his release.
The penalty faced by McGuire is 7 to 15 years in state prison and $10,000 fine.
Heather Rose Deem
Heather Rose Deem, 41, of 137 Shunpike Road, Mount Holly, Vermont was indicted for felony assault. On Aug. 27 at the Market Basket parking lot in Claremont, Deem struck another woman and pulled a purse off her arm with the intention of taking it.
The penalty faced by Deem is 3 ½ to 7 years in state prison and a $4,000 fine.
Deem was released on bail for the above offense, but failed to appear at Sullivan County Superior Court on Sept. 6 to face charges.
Henry T. Trzesiara
Henry T. Trzesiara, 41, of 431 Sunapee Street, Newport was indicted for the July 6 strangulation (second degree assault, domestic violence) of his intimate partner at 526 Main Street,Claremont.
The penalty faced by Trzesiara is 3½ to 7 years in state prison and a $4,000 fine.
Nieko T. Clow
Nieko T. Clow, 25, of 120 Connecticut Heights Road, Acworth was indicted for the Sept. 10 act of criminal mischief. He is charged with damaging a Volkswagen automobile that was not his own, by striking it often enough to cause a loss greater than $1,500.
The penalty faced by Clow is 3 ½ to 7 years in state prison and a $4,000 fine.
Howard P. Richards
Howard P. Richards, 53, of 40 Central Street, Apt. # 4, Claremont was indicted for criminal threatening with a deadly weapon, a felony offense. On June 7 Richards threatened a man and a woman with a wooden billy club,which is defined as a deadly weapon under New Hampshire state law.
The penalty faced by Richards is 3 ½ to 7 years in state prison and a $4,000 fine.
Richards was also indicted a second count because he was a previously convicted felon in possession of a deadly weapon. Richards was previously convicted in Windsor District Court of Vermont of unlawful trespass of an occupied residence on June 6, 2010.
The penalty faced by Richards is also 3 ½ to 7 years in state prison and a $4,000 fine.
Charles J. Hall
Charles J. Hall, 37, of 23 Pleasant St. in Alstead, was indicted for receiving stolen property on Jan. 15 and Feb. 15 in Charlestown. Hall did knowingly dispose of an Interarms .45 Colt pistol and a Savage .308, and Remington Rolling Block firearm, all the property of another person, knowing that they had been stolen, or believing that they had probably been stolen.
The penalty faced by Hall is 7 to 15 years in state prison and a $4,000 fine. Each weapon represents a separate count against Hall.
Hall was also indicted for being in possession of a deadly weapon after having been previously convicted of a felony.
The penalty faced by Hall for this count is 3½ to 7 years in state prison and a $4,000 fine. Each weapon represents a separate count against him.
Jewell A. Breed
Jewell A. Breed, 24, of 69 South River Street in Springfield, Vermont was indicted for bail jumping when she failed to appear on Sept. 6, at Newport in Sullivan County Superior Court. Her release was in connection with a charge of possession of a controlled drug, cocaine in this case, an offense punishable by imprisonment for a term of more than one year and less than 15 years’
The penalty now faced by Breed for the bailing jumping count is 3½ to 7 years in state prison and a $4,000 fine. For possession of controlled drug the penalty may be 3½ to 7 years in state prison and a $25,000 fine.
Donna Day
Donna Day, 53, of 19 Union Street in Lebanon was indicted for welfare fraud between Feb. 16, 2015 and Feb. 28, 2017 at Claremont. Day obtained Food Stamp and Cash Assistance benefits to which she was not entitled; failed to report a change in her household circumstances to the N.H. Department of Health and Human Services which would affect her eligibility for assistance, to wit: Day failed to report or disclose her daughter as a household member. As a result Day received more than $1,000 in assistance benefits to which she was not entitled.
The penalty now faced by Day is 7 to 15 years in state prison and a $4,000 fine.
Peter Tadros
Peter Tadros, 35, of 61 Maple Avenue in Barre, Vermont was indicted for welfare fraud committed between Dec. 1, 2011 and May 31, 2014, at Claremont. Tadros received food stamp and medical assistance benefits to which he was not entitled; he made intentional false statements to the N.H. Department of Health and Human Services that would affect his eligibility for assistance, to-wit: Tadros reported being a New Hampshire resident, when in fact he was not, resulting in his obtaining over $1,000 in assistance benefits to which the defendant was not entitled.
The penalty now faced by Tadros is 7 to 15 years in state prison and a $4,000 fine.
William N. Clark
William N. Clark, 45, of 992 2nd N.H. Turnpike in Unity, was indicted for criminal mischief on July 16 at Unity. Clark did more than $1,500 damage to a door and door handle at the Sullivan House of Corrections
The penalty faced by Clark is also 3½ to 7 years in state prison and a $4,000 fine.
Nathan A. Berg
Nathan A. Berg, 25, of 71 Annis Drive, Unit #18, Gilford was indicted for aggravated felonious sexual assault, domestic violence on June 30. Berg did knowingly engage in sexual acts with his intimate partner when she was asleep and physically helpless to resist. Berg was also indicted for further acts of sexual assault against Regina Berg between July 1 and 10. Berg was further indicted on the above counts for sexually assaulting his partner before she had an adequate chance to flee or resist because she was asleep.
The penalty for each of these indictments is 10 to 20 years in state prison and a $4,000 fine.
Alan W. Wirkkala
Alan W. Wirkkala, 51, of 483 John Stark Highway, Newport was indicted on several counts of aggravated felonious sexual assault on two juvenile girls over a number of years. Wirkkala is charged with knowingly engaging in sexual penetration and separately charged with sexual touching between the years of 1985 and 1987 at Hanover Street in Claremont when the girl was between 5 and 8 years old. Wirkkala is also charged with knowingly engaging in sexual penetration, separating charged with sexual touching with the same girl 1987 and July 1991 near Veterans Park, Claremont when she was between 11 and 12 years old. Separate indictments are brought against Wirkkala for similar assaults on Winter Street in Claremont during the same period when the victim was 8 to 12 years old.
Wirkkala is charged with several counts of felonious sexual assault for similar sexual acts with another girl at Plains Road, Claremont between 1987, when she 9 years old, and 1991, when she was 12 years old.
On each of these counts Wirkkala faces a penalty of 10 to 20 years in state prison and a $4,000 fine.
Robert Johnson
Robert Johnson, 26, of 31 High Street, Sunapee was indicted for bail jumping. Johnson had been released on $2,000 bail on Jan. 14 by Bail Commissioner Patrick Howe after being charged with the felony offense of reckless conduct with a deadly weapon, which is an offense punishable by a term of imprisonment of more than one year, but less than 15 years. Johnson failed to appear before Sullivan Superior Court for a scheduled arraignment as previously ordered on Feb. 8.
The penalty for bail jumping is 3½ to 7 years in state prison and a $5,000 fine.
Shaun Walsh
Shaun Walsh, 25, of 103 County Farm Road, Unity on Aug. 26 in Newport positioned his arm around the neck of his intimate partner and applied pressure and then strangled her. Walsh also used a knife to cut and/or slash the person of his partner, and caused her bodily injury. He also, while brandishing the knife stated he was going to kill her if she hit him over the head.
At the time of these offenses, Walsh had been released on bail for another offense.
The penalties for second degree assault, domestic violence, criminal threatening, and reckless conduct are 3½ to 7 years in state prison and a $4,000 fine for each offense.
Peter Davenport
Peter Davenport, 28, of, P.O. Box 463 Sheffield, Vermont was indicted for possession of cocaine on Aug. 11. Davenport had the cocaine, a schedule II controlled drug, in his vehicle.
The penalty for this offense is 3½ to 7 years in state prison and a $25,000 fine.
