Man resists arrest by locking car for two hours

BELLOWS FALLS, Vt. — A Lowell, Vermont man who was pulled over for a routine traffic stop was found to be in violation of conditions of release, and was allegedly confrontational with Bellows Falls Police officers before, during and after the arrest. 

Dylan Gingues, 37, of Lowell, was arrested for charges of violations of conditions of release and resisting arrest on Nov. 8. 

According to a report by Bellows Falls Police, at about 10:01 p.m., a Bellows Falls Police officer stopped a vehicle seen making a motor vehicle violation. The probable cause affidavit showed that the license plate was for a different vehicle, and police activated their emergency lights to make a stop near Atkinson and Russell Street. 

The report said that the vehicle continued north on Atkinson Street before pulling over in the area of Atkinson Street and Wells Street. When the officer was stepping out of his vehicle, Gingues allegedly reversed into a driveway. 

Gingues was identified as the operator, and officers found that he had conditions of release including a 24-hour curfew. Police told Gingues that he needed to exit the car and be placed under arrest, but officers reported that he refused to leave the vehicle and became confrontational.  

Police reported in the probable cause affidavit that there was an adult female and two children in vehicle, including a baby. The probable cause report stated that Gingues revved the engine and officers pleaded with him to put the car in park and not put the children at risk. 

“Officers began to negotiate with Gingues to resolve the situation peacefully,” the report stated. “After almost two hours Gingues exited the vehicle and was placed under arrest.” 

Gingues was taken to the Bellows Falls Police Department to be processed and was issued a citation to appear in Vermont Superior Court – Windham Criminal Division on Tuesday to answer the charges. He was held in lieu of $25,000 cash a surety at Southern State Correctional Facility. However, while officers tried to transport Gingues to the facility he allegedly began to resist their “efforts to effect transport.”  

The probable cause affidavit showed that police carried Gingues to the cruiser because he refused to walk. Police stated that they needed to put Gingues inside the cruiser. 

The Windham County Sheriff’s Office, Walpole Police Department and Vermont State Police Department assisted Bellows Falls Police with the arrest. 

Gingues had a recent run in with the Bellows Falls Police Department where he was tased after allegedly approaching an officer with broken glass bottles while acting in a “violent, tumultuous and threatening manner.”  

On Sept. 7 he was arrested on charges of Assault on a Law Enforcement Officer, Disorderly Conduct, Unlawful Trespassing and Unlawful Mischief. The Brattleboro Reformer reported that he allegedly refused to get dressed or go to the jail room for his arraignment, and then after he was taken to Springfield Prison, he needed to be “forcefully removed” when he began taking his clothes off. The report added that officers believed he was on drugs, and that Gingues made reference to PCP. 

His criminal history goes back to 2013, as he reportedly showed up naked to gas stations and convenience stores near the Bellows Falls Central Elementary School, according to a report by the Portsmouth Herald on Sept. 1, 2013.  

In other police news, on Nov. 8 at about 4:12 p.m., Bellows Falls Police arrested Aaron P. Laundry, 40, of Brattleboro for a warrant out of Bellows Falls stemming from arson and unlawful mischief charges. 

According to information released by Bellows Falls Police, Laundry was wanted on an in-state warrant for failure to appear to answer charges coming out of Bellows Falls Police investigation. Officers gathered information that led them to believe he was at Elliott Street in Brattleboro. 

Laundry was found and taken to the Bellows Falls Police Department, and then lodged at Southern State Correctional Facility in lieu of $1,000 cash/surety bail. 

Finally, a Massachusetts man who was allegedly speeding was also found to be operating a vehicle while on “drugs,” and now he is facing multiple charges after being arrested by Bellows Falls Police. 

According to a report by the Bellows Falls Police Department released on Monday, on Sept. 15 at 1:54 a.m. police pulled over Jared D. Kirchdorfer, 43, of Otis, Massachusetts, after allegedly observing him operating a vehicle at a “high rate of speed” on Atkinson Street. Officers reported that when they made contact with Kirchdorfer there were “indicators of impairment.” 

After administering standardized field sobriety tests, Kirchdorfer was placed under arrest for driving under the influence. He was taken to Bellows Falls Police Department for evaluation by a Drug Recognition Expert through the Windsor County Sheriff’s Department. 

Following the evaluation, a citation was issued to Kirchdorfer to appear in Vermont Superior Court-Windham Criminal Division on Nov. 26 to answer to charges of DUI (Drugs) and Negligent Operation.
