A Springfield man was charged with alleged domestic assault, but wound up with two additional charges after allegedly hitting and kicking the arresting officer.
Michael J. Mciver, 26, of Springfield, Vt. was arrested and arraigned on Nov. 6, and faces the alleged charges of Domestic Assault, Resisting Arrest and Assault on a Law Enforcement Officer. All three charges carry a potential penalty of imprisonment and/or a fine.
According to information provided by the Vermont Superior Court, Criminal Division Windsor Unit, Springfield Police officers were dispatched to a Newell Road residence for a report of domestic violence at 2:56 a.m. on Nov. 6.
The police conducted an investigation by speaking to parties involved and found reason to believe that Mciver had committed the crime, by taking testimony and viewing marks on the body of the victim. The report stated that Mciver refused to speak with officers, and gave them the middle finger while telling them to leave him alone. The Windsor County Deputy States Attorney determined that Mciver was the aggressor after reviewing evidence from the investigation by officers at the scene.
Officers then told Mciver to get out of a bed he was laying in, and that he was being placed under arrest. He allegedly refused to get up and indicated he was not listening to the demands of the police. An officer tried to grab Mciver’s arm and he pulled away twice, with the second leading the officer to fall to the ground and hit his head.
The report alleges that the officer attempted to grab Mciver again by reaching out his arm to grab his hand, and Mciver hit his hand to get him away. The officer said the hit to the head was a three out of 10 on the pain scale, and the hand was a four out of 10 rating.
Officers got him on the ground and tried to put his hands behind his back, but Mciver reportedly continued to resist arrest. He then allegedly kicked an officer in the chest and ribs trying to escape. The officer rated the pain three out of 10.
The penalty for Domestic Assault is imprisonment of no more than 18 months, or fined not more than $5,000, or both. Assault on a Law Enforcement Officer carries a penalty of not more than a year in prison or fined not more than $500, or both. Resisting Arrest has a penalty of imprisonment of not more than a year or fined not more than $500, or both.
Mciver was taken to the Springfield Police Department to be processed. He was subsequently lodged at Southern State Correctional Facility in lieu of $1,000 cash or surety bail.
